Palestinian scholar issues fatwa against Hamas’ Oct. 7 attack
A prominent Palestinian Islamic scholar in Gaza has issued a fatwa (Islamic ruling) condemning Hamas’ Oct. 7, 2023, attack on Israel.
The attack, in response to Israel’s occupation of Palestine, led to a brutal Israeli response, which has almost leveled Gaza and killed over 43,000 Palestinians, mostly children and women.
Salman al-Dayah, a former dean at Gaza’s Islamic University, criticized Hamas for violating Islamic principles governing jihad.
According to the fatwa, the attack failed to meet the necessary conditions for jihad, which must prioritize the protection of civilian lives.
Dayah emphasized that such violence, resulting in widespread destruction in Gaza, contradicts Islamic teachings.
The ruling was published in a six-page document.
Although the fatwa is a nonbinding legal ruling based on Islamic legal sources, it is significant given Dayah’s influential role in Gaza’s religious community, observers say.
It adds to the growing debate within Gaza and the wider Arab world about the ethical and legal implications of the attack.
The Oct. 7 attack saw hundreds of Hamas gunmen from Gaza breaching southern Israel.
About 1,200 people were killed and 251 others taken hostage.
