Advocacy group files lawsuit in Minnesota to bar Trump from 2024 elections
Lawsuit, filed in the Minnesota Supreme Court, argues that Trump is disqualified from holding office under the 14th Amendment to the Constitution
SAINT PAUL, Minnesota – A group of Minnesota voters filed a lawsuit Tuesday seeking to bar former President Donald Trump from the 2024 presidential election.
The lawsuit, filed in the Minnesota Supreme Court, argues that Trump is disqualified from holding office under the 14th Amendment to the Constitution.
The law prohibits anyone who has taken an oath to the U.S. Constitution and then “incited insurrection or rebellion” from holding civil or military office.
The lawsuit cites Trump’s actions in the run- up to and on Jan. 6, 2021, when a mob of his supporters stormed the U.S. Capitol to overturn the results of the 2020 election.
“To pressure Pence, Trump summoned tens of thousands of supporters to Washington for what he called a ‘wild’ protest on January 6, 2021, the day that Congress would count and certify the electoral votes,” the lawsuit claims.
“Although Trump knew that these supporters were angry and that many were armed, Trump incited them to a violent insurrection and instructed them to march to the Capitol to ‘take back’ their country.”
The plaintiffs argue that Trump’s actions amounted to a riot and therefore he should no longer be allowed to run for president.
The lawsuit is the latest in a series of challenges to Trump’s eligibility to run.
In July, a group of voters filed a similar lawsuit in Colorado, and similar lawsuits are pending in other states.
According to experts, the filing of the lawsuit by Free Speech for People (FSFP); a legal advocacy group, is a sign of growing momentum in efforts to prevent Trump from running again.
The group is represented by eight state residents, including former political leaders.
Section 3 of the 14th Amendment was passed after the third Civil War in 1865 to prevent former Confederate officials from holding office.
